Cheyenne home sellers, buyers and real estate professionals all believe the sale and purchase of a home is one of the most significant events any one person may experience in their life. The purchase of housing reflects a person’s hopes, dreams, aspirations and economic destiny of all those involved.
The Fair Housing Act makes illegal any discrimination in the sale, lease or rental of housing, or making housing otherwise unavailable, because of race, color, religion, sex, handicap, familial status, or national origin. (NAR/www.hud.gov).
The home seller/landlord has a responsibility under the law to not discriminate based on the Fair Housing Act as well as not to instruct a licensed sales person acting as their agent to convey for you any limitations in the sale or rental of your property. A seller/landlord cannot establish discriminatory terms or conditions in the purchase or the rental; deny that housing is available or advertise that a property is only available to persons of a certain race, color, religion, sex, handicap, familial status or national origin.
The home buyer has the right to expect that housing will be available to you without discrimination or other limitations based on race, color, religion, sex, handicap, familial status or national origin. This includes, but not limited to price range, professional service, range of housing choices, communities or locations, financing, appraising or insuring, and free from harrassment or intimidation for exercising your fair housing rights.
Real estate professionals are prohibited by law from discriminating on the basis of race, color, religion, sex, handicap, familial status or national origin. A request from the home seller/landlord to act in a discriminatory manner in a sale, lease or rental cannot legally be fulfilled by a real estate professional. Real estate professionals are bound by Artical 10 in the NAR Code of Ethics to uphold the Fair Housing Act.
If there is any suspicion of violations of this Act, please contact the local Board of Realtors or a complaint may also be filed with the United States Department of Housing and Urban Development (HUD) or by contacting them at www.hud.gov.
